How soon after a death should we contact a lawyer?
There is no strict requirement, but it is generally helpful to make contact within a few weeks. Some procedural steps have deadlines under Thai law, and knowing about them early avoids unnecessary complications. An initial call or meeting does not commit you to anything and helps the family understand what may need attention soon versus what can wait.
What if there is no will?
Thai law provides a clear order of succession for intestate estates — that is, estates where no will was left. The Civil and Commercial Code identifies six classes of statutory heir, and the distribution follows those rules. Probate proceedings are still required to appoint an administrator and distribute the estate formally. We walk families through how this applies to their particular situation.
How long does probate typically take in Thailand?
Straightforward estates without real property or business interests may conclude within four to six months. Estates that include land, condominiums, or business interests typically extend to eight to fourteen months, sometimes longer depending on the complexity of the assets and whether any disputes arise. We give a realistic estimate once we have reviewed the specific estate.
What happens if family members disagree about the will?
Disputes can arise over the testator's capacity at the time of signing, whether undue influence was present, whether the document meets formal requirements, or how particular provisions should be interpreted. Our approach is to assess the basis for each concern carefully and to pursue mediation first where possible. Most disagreements between family members are better resolved through conversation than through formal proceedings.
Do foreign nationals require different procedures for Thai estates?
Estates where the deceased was a foreign national, or where beneficiaries hold foreign nationality, can involve additional steps — particularly where property ownership restrictions apply under Thai law. We are familiar with the documentation requirements and the relevant restrictions on land and condominium ownership, and we advise accordingly.
What is included in the initial estate inventory session?
The session covers a reading of the will (where one exists), a structured review of known assets and obligations, an explanation of the legal steps the estate requires, and a frank note about timing — which decisions need attention soon, and which may reasonably wait. We prepare a written summary afterwards that the family can refer to at home.
