How We Approach Every Engagement
Whatever service a family requires, certain things remain constant across every engagement at Asoka Counsel.
Listen First
The first meeting is for understanding. We ask questions, review available documents, and form a clear picture before offering any recommendation.
Set Out the Path
We explain — in plain language — what the legal process involves, what the realistic options are, and what each option is likely to cost and take.
Proceed Methodically
Legal steps are taken in the correct order, with accurate documents, and to required deadlines. We handle the procedural weight so the family can focus on other things.
Report and Conclude
At each significant stage, we provide a written update. At the conclusion of the matter, a final written summary documents what was achieved and how.
Service One
Will Reading & Estate Inventory
฿3,600
A patient first engagement for families following the loss of a relative — a structured but unhurried session in which we read through the will (where one exists), inventory the deceased's known assets and obligations, and explain what the law requires next.
The session is intentionally calm in tone. Many families reach out within days or weeks of a loss, and the goal is to bring clarity rather than to rush toward any particular procedural step. We prepare a written summary the family may keep, listing the estate's apparent assets, the named beneficiaries, the likely procedural path forward, and a note of which decisions require attention soon versus which may wait.
Full reading of the will and explanation of each provision in accessible language
Structured inventory of known assets — property, accounts, vehicles, business interests
Written summary provided afterwards for the family's own records
Clear note on time-sensitive decisions versus matters that may wait
Suitable as the starting point for families newly facing estate responsibilities
Typical Process Steps
Initial Call or Email
A brief telephone or email exchange to understand the situation and confirm whether this service fits the family's needs.
Document Collection
Family brings the will (if available), identification documents, and any property or account records they have to hand.
Session at Our Chambers
An unhurried meeting — typically 90 minutes to two hours — covering the will, assets, and next steps.
Written Summary Delivered
Within five working days of the session, a written summary is provided by email and in hard copy.
Typical Timeline
Months 1–2: Will verification, beneficiary identification and notification, petition preparation
Months 2–4: Court application for executor appointment; court hearing
Months 4–8: Asset inventory, creditor publication notices, claims management
Final stage: Account preparation, court approval, and distribution to beneficiaries
Service Two
Probate Court Representation
฿14,200
Comprehensive representation of executors and administrators through Thai probate proceedings. The engagement begins with verification of the will's formal validity, identification and notification of beneficiaries, and preparation of the application for an executor's appointment.
Once the appointment is in hand, we coordinate the inventory of estate assets, prepare the schedule of liabilities, manage publication notices and creditor claims, and prepare the final account for court approval. Throughout, we provide steady written updates and accompany the executor to all required court appearances.
Will validity verification and beneficiary notification
Full court representation — we accompany the executor to every required hearing
Creditor publication and claims management
Final estate account preparation and court approval
Pace adapts to the family's needs — some estates conclude within months, others extend longer
Service Three
Contested Will Mediation & Litigation
฿14,800
Considered representation in contested-will matters, with a strong preference for mediation before any escalation to formal proceedings. The engagement begins with a careful assessment of the basis for contest — testamentary capacity questions, undue influence concerns, formal validity issues, or interpretation disputes — and a frank conversation about realistic prospects.
Where mediation is suitable, we conduct sessions with the other family members at a measured pace, recognising that the underlying family relationships often matter more than the specific document being contested. Where mediation does not produce resolution, we prepare and present the matter through formal court proceedings.
Assessment of each ground for contest and frank discussion of realistic prospects
Structured mediation sessions with family members as preferred route to resolution
Formal litigation prepared and presented if mediation does not succeed
Communication conducted with care — avoiding sharp language in written correspondence
Covers testamentary capacity, undue influence, formal validity, and interpretation disputes
Grounds We Commonly Assess
Testamentary Capacity
Whether the testator had the mental capacity required by law at the time of signing.
Undue Influence
Whether the testator was improperly pressured by another person in ways that affected the document.
Formal Validity
Whether the will meets the formal requirements of Thai law — witnessing, signing, date, and format.
Interpretation Disputes
Where provisions are ambiguous or where family members disagree about what a provision means.

Shared Across All Services
Professional Standards We Apply to Every Matter
Full Confidentiality
All estate information is held under legal privilege. Family details, asset schedules, and dispute circumstances are not disclosed outside the engagement without written authority.
Written Engagement Terms
Every engagement is governed by a clear written agreement before formal work begins. Scope, fees, and responsibilities are documented and agreed in advance.
Deadline Management
We track all legally required deadlines across the estate and notify the family in advance of each one. Missed deadlines in probate proceedings can extend timelines significantly.
Regular Written Updates
Clients are kept informed at each significant stage without needing to chase for news. Updates are provided in writing and explained in plain language.
Consistent Counsel Contact
Clients deal with the same counsel throughout their engagement. The person who takes on a matter sees it through — families do not need to re-explain their situation.
No Scope Creep Without Consent
If a matter requires work beyond its original scope, we discuss the additional cost before proceeding — not afterwards.
Transparent Fixed Fees
Clear Pricing for Each Service
All fees stated in Thai Baht. No hidden charges. Any extension of scope is discussed before it is incurred.
